Key points:

  • Roger Ver, aka “Bitcoin Jesus,” reached a $50M deferred prosecution deal with the DOJ to resolve his federal tax case.
  • Ver admitted failing to report full Bitcoin holdings on his 2016 tax returns, resulting in over $16M in unpaid taxes, plus penalties exceeding $12M.
  • The agreement includes dismissal of the indictment and spotlights broader issues around taxation of digital assets and compliance for expatriates.

The DOJ announced that Ver has reached an agreement to resolve federal tax charges, agreeing to pay the Internal Revenue Service (IRS) nearly $50 million in back taxes, penalties, and interest. The charges stem from Ver’s alleged “willful failure” to report his Bitcoin holdings on tax returns after renouncing his U.S. citizenship in 2014.

The U.S. government has filed to dismiss the indictment against Ver as part of the agreement. In it, Ver acknowledged that his May 2016 tax returns failed to report his full Bitcoin holdings and omitted the required capital gains taxes on their constructive sale, resulting in a loss of over $16 million to the United States.

Furthermore, Ver acknowledged that he owed the maximum penalty under 26 U.S.C. § 6663, exceeding $12 million, in addition to accrued interest on the taxes and penalties.

In 2014, Ver renounced his U.S. citizenship after acquiring citizenship in St. Kitts and Nevis. Due to his net worth, he was required to file expatriation-related tax returns and report capital gains on global assets, including his Bitcoin holdings.

In December 2024, Ver submitted a motion to dismiss the charges, contending that the IRS “exit tax” was unconstitutional and lacked clear legal definition.

Earlier this year, Ver publicly appealed to President Donald Trump, seeking intervention to prevent his potential extradition to the U.S. Ver, an early Bitcoin advocate, faces legal scrutiny over alleged violations connected to his promotion of certain cryptocurrency ventures.

The legal challenges trace back to his involvement with the Bitcoin Cash network, which forked from Bitcoin in 2017. Authorities allege Ver promoted projects and individuals later linked to fraud and money laundering, drawing him into ongoing legal disputes.

The resolution of Ver’s tax case could have wider implications for expatriates and crypto investors alike, emphasizing ongoing debates over the taxation of digital assets and cross-border financial compliance.

A rebellion brews in the digital realm: the cryptocurrency industry is not backing down, as three major advocacy groups file a lawsuit against the Internal Revenue Service (IRS), challenging new rules that could fundamentally alter the way DeFi operates. The fight is on, and the outcome is far from certain.

Conversations about the future of decentralized finance moved to the courtroom. The DeFi Education Fund, the Blockchain Association, and the Texas Blockchain Council contested the IRS’s move to classify DeFi platforms as “brokers.” arguing it oversteps the agency’s authority, violates the Administrative Procedure Act (APA), and is unconstitutional.

Lawsuit vs. The IRS

The lawsuit, filed on December 27, 2024, challenged the IRS’s final “broker” rulemaking, published in the Federal Register the same day. This rule expands the definition of a “broker” to include decentralized exchanges (DEXs) and other front-end platforms facilitating digital asset transactions.

IRS New DeFi Rule Faces Fiery Legal Challenge: The Fight for Crypto’s Survival

Specifically, these regulations require DeFi platforms to collect and report detailed information on crypto transactions. This includes gross proceeds, transaction dates, and user identities (names, addresses, TINs) using Form 1099-DA. These rules, slated for 2027, aim to enhance transparency and combat tax evasion.

DeFi Groups Push Back IRS Rulemaking

However, the crypto groups argued the IRS and Treasury have exceeded their authority, as DeFi platforms don’t “effectuate” transactions like traditional brokers. They also claimed the rules impose undue burdens on software developers, who often lack access to the required user data, potentially stifling innovation and pushing entrepreneurs offshore.

“The IRS and Treasury have gone beyond their statutory authority in expanding the definition of ‘broker’ to include providers of DeFi trading front-ends even though they do not effectuate transactions,” said Marisa Coppel, Head of Legal, Blockchain Association. “Not only is this an infringement on the privacy rights of individuals using decentralized technology, it would push this entire, burgeoning technology offshore.”

The lawsuit also alleges violations of the APA and the Constitution, arguing the IRS did not follow proper procedures and infringes on user privacy. The groups point out that public warnings during the rule’s comment period were ignored.

“We are incredibly disappointed in today’s decision by the Treasury and the IRS to finalize the misguided and unfairly sweeping DeFi portion of their ‘broker’ rulemaking,” said Miller Whitehouse-Levine, CEO, DeFi Education Fund. “This unfortunate rulemaking is a direct threat to financial innovation, and we intend to fight it.”

The IRS’s move has sparked controversy, with industry leaders criticizing the timing and calling for legislative intervention.

“The new IRS broker rule imposes unrealistic expectations on the digital asset ecosystem,” said Texas Blockchain Council President Lee Bratcher. “This regulatory overreach risks driving critical development overseas.”

The Broader Impact on DeFi and Crypto Innovation

The lawsuit came amid increasing regulatory scrutiny of the crypto industry. The outcome could significantly impact the future of DeFi and the broader digital asset ecosystem.

The legal battle is likely to be protracted, with the potential to reshape the regulatory landscape for digital assets in the U.S. The case will be closely watched by both the crypto industry and policymakers, as it raises fundamental questions about the balance between innovation, regulation, and individual rights.

The fight is on, and the outcome is far from certain.

The U.S. Department of Treasury announced yesterday that it recovered $4 billion in fraud and improper payments during the 2024 fiscal year using artificial intelligence (AI) technology.

This is a substantial increase from the previous year when the department recovered $652.7 million in fraudulent transactions.

According to Treasury official Renata Miskell, the department began quietly integrating machine learning AI in late 2022. The technology has been used to analyze large sets of data and detect patterns that indicate fraudulent behavior. “It’s really been transformative,” Miskell said, emphasizing that “leveraging data has upped our game in fraud detection and prevention.”

Miskell explained that fraudsters often attempt to manipulate the system in ways that are difficult to detect. The application of AI has allowed the Treasury to identify hidden patterns that human reviewers might miss. “Fraudsters are really good at hiding,” she said. “They’re trying to secretly game the system. AI and leveraging data helps us find those hidden patterns and anomalies.”

Treasury Uses AI-Powered Fraud Detection for Payment Review

The Treasury currently processes approximately 1.4 billion payments each year, with a total value of around $6.9 trillion. Deputy Secretary of the Treasury Wally Adeyemo stated that the department “takes seriously our responsibility to serve as effective stewards of taxpayer money,” noting the role of AI in these efforts.

In May 2024, the department revealed plans to expand its use of AI, aiming to improve government regulatory and enforcement efforts in the fight against financial crimes. AI technology also helped the department sift through enormous amounts of data quickly and more effectively identify improper payments.

Other Government Departments Adopting AI

Meanwhile, other U.S. government departments have also adopted AI-powered fraud detection initiatives. In September 2023, the Internal Revenue Service (IRS) announced its deployment of AI to review complex tax returns from hedge funds and law firms to identify tax evasion.

Juniper Research estimates that online payment fraud could surpass $362 billion by 2028, reinforcing the need for advanced technologies like AI in government efforts to combat financial fraud.

Overall, the Treasury’s use of AI is part of its ongoing efforts to safeguard taxpayer funds by identifying and recovering improper payments and preventing scam activity.
