As President Donald Trump begins his term, his newly established advisory group, the Department of Government Efficiency (DOGE), has been hit with legal challenges over its adherence to federal transparency laws.
A report from The Washington Post on January 20 revealed that the National Security Counselors (NSC) filed a 30-page legal complaint, claiming that the Elon Musk-led agency qualifies as a federal advisory committee.
As such, the agency is required to adhere to specific governance standards, including the submission of a formal charter. According to the complaint, DOGE failed to meet these requirements, violating the Federal Advisory Committee Act (FACA) of 1972.
In the complaint, Kel McClanahan, executive director of the NSC, argued that similar agencies must adopt a more transparent and balanced approach. This includes documenting meeting minutes and ensuring public access to the proceedings.
“DOGE is not exempted from FACA’s requirements […] “All meetings of DOGE, including those conducted through an electronic medium, must be open to the public,” the complaint stated.
In November 2024, President Trump selected Musk and entrepreneur Vivek Ramaswamy to head the agency with the goal of enhancing governmental efficiency.
However, over the weekend, reports suggested that Ramaswamy may be considering leaving his position on the advisory committee due to internal tensions within DOGE. He has not yet made a public statement on the matter. In addition, sources indicate that Ramaswamy is preparing to announce his candidacy for Ohio governor by the end of the month.
DOGE is slated to complete its work by July 4, 2026, with the goal of achieving a more streamlined government that operates with greater efficiency and reduced bureaucracy.
Warren’s Critiques
Since its inception, DOGE has faced criticism and has been met with a range of differing opinions. After Musk and Ramaswamy were appointed to lead the agency, Senator Elizabeth Warren, a prominent crypto critic, raised concerns about the agency’s leadership and questioned its overall effectiveness.
“The Office of Government Efficiency is off to a great start with split leadership: two people to do the work of one person. Yeah, this seems REALLY efficient,” Warren stated in an X post, expressing her disapproval of the department’s dual leadership structure.
At the time, Musk’s appointment sparked debate given his vocal support for the meme cryptocurrency Dogecoin, and his tendency to make bold statements on social media. Additionally, the department’s acronym, “DOGE,” which mirrors the name of the cryptocurrency, has raised concerns and prompted speculation about the agency’s objectives and its potential influence on the crypto industry.
